2. Information on the processing of personal data and the use of cookies and files
Personal data will only be collected and processed by us if and insofar as this is permitted under the applicable regulations for the protection of personal data or if you have given us your consent. If we process personal data on the basis of your consent, this consent can be revoked at any time vis-à-vis the controller or the data protection officer (Section 1) without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.
„Personal data“ means any information relating to an identified or identifiable natural person. This includes, in particular, name, address, email or IP address and user behaviour.

2.1. Processing of personal data when visiting our website
2.1.1. Automatic information (server log files)
It is generally possible to visit our website without registering or logging in. When you visit our website, we collect information from you that is transmitted by your browser to our website server for technical reasons. We store this information for a period of 30 days and then delete it. When you visit our website, we collect:
- IP address,
- Requesting provider,
- Date and time of the server request,
- File name and URL/address that you have accessed,
- Access status/http status code,
- Amount of data transferred,
- Referrer URL (the previously visited website),
- Browser,
- Operating system and its interface and
- Language and version of the browser software.
Insofar as the above information has a personal reference, the legal basis for its processing in accordance with Art. 6 (1) sentence (1) (f) GDPR is our legitimate interest in the provision of our website. It is not technically possible to provide the website without processing the aforementioned information.
The information is disclosed to our hosting provider on the basis of Art. 6 (1) sentence (1) (f) GDPR, as we have a legitimate interest in web hosting by our external service provider.
2.1.2. Further data processing
The provision of further personal data is voluntary. In principle, there are no negative consequences for you if you do not provide us with any further personal data. In certain contexts, however, we as the controller require your personal data in order to take action, e.g. to be able to process an enquiry from you. In these cases, we cannot provide the service or take the action you have requested without access to the personal data required for this. You can find more detailed information on the individual services, functions and applications implemented on our website through which personal data can be processed in the following explanations.
2.2. Cookies
We use so-called cookies when operating our website. Cookies are small text files that can be stored by the browser in your device (e.g. computer, tablet or mobile phone) when you visit a website and that we or a third-party provider can read. They are used to identify your device for a certain period of time. A basic distinction is made between technically essential cookies and technically unnecessary cookies. We only use technically necessary cookies. These therefore do not require consent.
The legal basis for storing and accessing the information stored in your device is Section 25 (2) No. (2) (Telecommunications Digital Services Data Protection Act – TDDDG).
2.3. Processing of personal data when using individual functions of our website
2.3.1. Processing of personal data when contacting us
We process information and personal data that you transmit to us for the purpose of contacting us or as part of an enquiry. This includes, for example, data that you send us via our contact form or with and in an e-mail (e.g. e-mail address, name, address, telephone number, etc.). In order to be able to respond to such enquiries, and to be able to process them in accordance with the purpose of your enquiry, we must access and process the personal data provided with the respective enquiry.
The legal basis for the processing of your personal data is Art. 6 (1) sentence (1) (f) GDPR due to our legitimate interest in processing and responding to your enquiry. If you contact us as a contact person, employee, service provider or vicarious agent of an interested party, the processing is also carried out on the basis of Art. 6 (1) sentence (1) (f) GDPR due to our legitimate interest in processing your enquiry.
2.3.2. Public ZEREZ register
The Electrotechnical Properties Verification Ordinance (NELEV) provides for the introduction of a register for unit and component certificates. Unit and component certificates serve as proof of compliance with the general minimum technical requirements within the meaning of § 19 EnWG. According to Section 4 (1) NELEV, the ZEREZ is a database within the meaning of Section 49 (4) sentence (1) no. (9) EnWG and is operated as an electronic directory for both unit and component certificates. The Federal Ministry for Economic Affairs and Climate Protection has authorised FGW e. V. in accordance with Section 49d (3) sentence (1) EnWG. FGW e. V. also serves as the operator of the register.
Registration is not required to view the public ZEREZ register. You can use the public ZEREZ register to view publicly available unit certificates. The ZEREZ register contains (non-personal) data on the validity of unit and component certificates of production plants, the issue date and, if available, the expiry date of unit and component certificates, an individual registration number assigned to each unit and component certificate by the operator of the register, as well as the other unit and component certificate data required for the grid connection of production plants. However, extended functions (e.g. uploading a certificate) are only possible after successful registration.
Accessing the public register on our website may result in the processing of personal data (see 2.1 above).
2.3.3. User account
In order to become a qualified user of the register and thus have their own user account, natural or legal persons are registered on application. Registration is possible for manufacturers of production plants, grid operators, certification bodies as well as planners, installers and operators of energy production plants. To register, you can set up a user account for the ZEREZ register on our website under the heading „Register“. As part of the registration process, you must provide the required mandatory information (e.g. company/organisation name, address and contact details such as telephone number and email address, contact person), and you can also provide additional voluntary information (e.g. …). We check the registrations for plausibility and, if necessary, request clear proof of identification. In the case of natural persons, this would require the submission of identity documents.
Registration for the user account and its use are not possible without processing your data. If you use the user account after registration, the processed data includes in particular the login information (user name, password and e-mail address). You can use your user account to manage your data and utilise various services from us (e.g. uploading certificates). For example, manufacturers of units or components for production plants are obliged to submit the unit or component certificates issued to them to the operator of the register for registration. If you upload a certificate via your user account, we also process the data on the certificate.
If your personal data is collected and processed as part of the registration and further use of the user account, your personal data is processed on the basis of Art. 6 para. (1) sentence (1) (b) GDPR to fulfil a contractual relationship between you and us. Your personal data is also processed on the basis of Art. 6 para. (1) (c) GDPR for the fulfilment of a legal obligation or on the basis of Art. 6 para. (1) (e) GDPR for the fulfilment of a public task. The FGW e. V. is entrusted with the operation of the ZEREZ as an entrusted body. The legal basis for the entrustment of FGW e. V. is Section 49d (3) sentence (1) EnWG. If you contact us as a contact person, employee, service provider or vicarious agent of one of our customers or make your entries, the processing is carried out on the basis of Art. 6 para. (1) sentence (1) letter (f) GDPR due to our legitimate interest in processing your input for the obligated party.
If we have collected your personal data, we will disclose this data to third parties to the extent necessary. Third parties include, in particular, the FGW Advisory Board. For example, your submitted application documents must be reviewed and evaluated by the FGW Advisory Board in order to carry out the admission process. The current composition of the FGW Advisory Board can be communicated at any time via the office. The data transmitted to third parties will be used by them exclusively for the purpose for which they are intended and in accordance with the obligations or tasks incumbent on these third parties.
2.3.4. Current information on the ZEREZ
We process the data you provide when registering a user account in order to inform you about current developments regarding selected topics in relation to the ZEREZ database.
Insofar as we process your personal data in the context of informing you about current developments at ZEREZ, this is done on the basis of Art. 6 para. (1) (b) GDPR to fulfil the contractual relationship between you and us for the use of ZEREZ. If you contact us as a contact person, employee, service provider or vicarious agent of one of our customers or make your entries, the processing is carried out on the basis of Art. 6 para. (1) sentence (1) letter (f) GDPR due to our legitimate interest in providing information about ZEREZ
3. Disclosure of personal data to other recipients or transfer to or in third countries
Your personal data will only be disclosed or transferred to companies that act as processors for us as defined in Art. 28 GDPR (in particular hosting of the domain and maintenance of the register portal) within the scope of the purposes mentioned above in section 2.
We also transfer your personal data to third parties if this is necessary to fulfil your order or enquiry. The data transmitted to these third parties will be used by them exclusively for the fulfilment of your order or your enquiry in accordance with the obligations or tasks incumbent on these third parties.
By placing data in the public database of ZEREZ, other third parties may also be able to view your personal data. This applies in particular to personal data that is located on certificates, for example.
Your personal data will not be transferred to or in third countries or to international organisations except in the cases specified in this privacy policy.
4. Storage duration
Your personal data, which we process on the basis of a legal permission or on the basis of your consent, will only be stored for as long as this is necessary for the purposes specified above in section 2, for example to answer your enquiry or to fulfil a contractual relationship.
5. Rights in relation to the processing of personal data
You have the following rights vis-à-vis us with regard to your personal data:
- Right to information about your stored personal data (Art. 15 GDPR),
- Right to rectification if the stored data concerning you is incorrect, outdated or otherwise inaccurate (Art. 16 GDPR),
- Right to erasure if the storage is unauthorised, the purpose of the processing is fulfilled and the storage is therefore no longer necessary or you have withdrawn your consent to the processing of certain personal data (Art. 17 GDPR),
- Right to restriction of processing if one of the conditions set out in Art. 18 (1) GDPR is met (Art. 18 GDPR),
- Right to transfer the personal data concerning you that you have provided (Art. 20 GDPR),
- Right to withdraw consent, whereby the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal (Art. 7 (3) (c) GDPR) and
- Right to lodge a complaint with a supervisory authority (Art. 77 GDPR).
6. Right of objection
You can object to the processing of your data that we base on Art. 6 (1) (e) or (f) GDPR at any time for reasons arising from your particular situation, stating these reasons. In the event of a justified objection, we will generally no longer process the personal data for the purposes concerned and delete the data unless we can prove compelling reasons for the processing that outweigh your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.
